2023: APC Assembly candidate sacked by court in Cross River State
A federal High Court sitting in Calabar and presided over by Justice Rosemary Dugbo Oghoghorie has nullified the primaries of the All Progressives Congress (APC) for the Yala II State Constituency on Thursday, November 3, 2022.
The ruling sacked the lawmaker representing the Yala 11 state Constituency, Honorable Cynthia Nkasi as the candidate of the party and barred her publicity materials as a candidate for the 2023 polls.
The judgment delivered by Justice Dugbo held that the plaintiffs in suit number FHC/CA.CS/140/2022, clearly showed that Mrs. Nkasi did not emerge as a candidate through due process of law.
The plaintiffs in the suit were the PDP and its candidate for the constituency, Dr. Martins Achadu while the Independent National Electoral Commission, APC, and Mrs. Nkasi were listed as the first, second, and third defendants respectively as the first defendant was said not to have monitored the primaries conducted by the second defendant.
Justice Dugbo granted the prayers of the plaintiffs for an order nullifying the first defendant’s listing of the third defendant to contest with the first and second plaintiffs and also ordered the first defendant not to accept, recognize or include the third defendant as the candidate of the second defendant to contest against the plaintiffs in March 2023 elections to be conducted by INEC.
